Terms and conditions of use and sale
1. General Provisions
These general conditions of sale (right away, “General conditions”) apply to all product sales (right away, “Products” O “Product”) purchased through the website antichisaporisicilia.com (right away “Site”).
The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (right away “Clients” or the “Customer”), understood as natural persons who act for purposes unrelated to their commercial activity, entrepreneurial or professional activity.
The language available to conclude the contract is Italian.
The Customer is required to carefully read the General Conditions that have been made available to him on the Site, in order to allow storage and reproduction by the Customer pursuant to art. 12 of the Legislative Decree 9 April 2003, n. 70.
Contracts concluded with Antichi Sapori (as defined below) through the Site are governed by Italian law e, particularly, by the Legislative Decree 6 September 2005, n. 206 (“Consumer Code”) and the Legislative Decree 9 April 2003, n. 70 (right away, “Ecommerce Decree”).

3. Information relating to the Products
Information relating to Products that can be sold remotely through the Site is available, with the related product codes, on the site.  The aforementioned information is provided in accordance with the articles 52 e 53 of the Consumer Code.

4. Price
The prices of the products are inclusive of all taxes and duties. All prices are expressed in Euros. Shipping costs are charged to the customer, except for any promotions and available on the shipping costs page.5. Order of Products
The essential characteristics and prices of the Products are shown in the offer relating to each Product.
To purchase the Products, the Customer must complete the online order form and send Antichi Sapori the order form in electronic format, following the instructions contained on the Site. The Customer must put the Product in the appropriate “cart” e, after having read the General Conditions, with particular reference to contribution for delivery costs and how to exercise the right of withdrawal, and to Privacy Policy, will have to select the desired payment method and choose the option “Confirm order”.
Before submitting their purchase order, the Customer will have the opportunity to correct any data entry errors by following the appropriate modification procedure contained on the Site. Particularly, the Customer has the right to change the quantity of the Products he intends to purchase, adding or deleting one or more Products from the “cart”.
By sending the order, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions.
The Customer will have the opportunity to view and follow the status of his order through the area “Orders” of your account. Antichi Sapori reserves the right to evaluate the acceptance of orders received. Antichi will notify the Customer of any inability to accept orders received by 30 days from the day following that on which the Customer sent the order to Antichi Sapori and will refund any amounts already paid by the Customer for the payment of the supply.

6. Terms of payment
The Customer may pay the price of the Products and the related delivery costs by credit card, PayPal, PostePay (on a secure and protected PayPal server) or by bank transfer, or by cash on delivery payment.
Payments made with all major companies are accepted Credit cards, including: Visa, MasterCard e American Express.
The transaction will be charged to the Customer's credit card only after that:
a) your credit card details have been verified (on a secure server directly from PayPal, we will have no direct access to your data),
b) the debit authorization has been received from the company issuing the credit card used by the Customer e
c) the availability of the Product by Antichi Sapori has been confirmed.

Antichi Sapori also accepts payments made by Wire transfer. Any bank charges will be charged to the customer.
In the case of, for whatever reason, the debit of the amounts due by the Customer proves impossible, the sales process is automatically canceled and the sale is automatically canceled. In the case of Cash on delivery, that is in Cash on delivery, the customer must pay exclusively in cash directly to the courier who, after receiving the payment, will deliver the goods. Cash on delivery can only be made for orders with a maximum amount of 450 euro. This limit is mandatory. The Cash on delivery service has an additional cost of 7 euro. All other payment methods have no surcharge.

7. Confirmation of receipt of the order
In accordance with the provisions of art. 53 of the Consumer Code, the Customer receives, at the time of execution of the contract, by e-mail, confirmation of receipt of the purchase order sent by the Customer, containing a summary of the General Conditions, of the essential characteristics of the ordered product, of its price, of the amount paid, the existence of the right of withdrawal – with an indication of the times and methods for returning the asset – the geographical address to submit any complaints and information on the assistance services and existing commercial guarantees.

8. Ineffectiveness of the order
No contract must be concluded between Antichi Sapori and the Customer if Antichi Sapori has reasonable grounds to believe that the Customer does not operate on the basis of an effective and genuine interest in purchasing the products ordered, or abusively exercise the right of withdrawal recognized in Article 10 below. In such cases, the order forwarded by the Customer must be deemed to have no effect whatsoever. Antichi Sapori will send to the customer, by e-mail, a communication certifying the failure to conclude the Contract, also taking care of the cancellation of any charges and / or expenses borne by the Customer.

9. Transport and delivery
The Products purchased on the Site will be delivered to the address indicated by the Customer. In any case, the Customer has the right to request the delivery of the products to a natural person of his choice, whose residence or domicile is located within the Italian territory. At the time of delivery, the signature of an adult older than years will be required 18. No deliveries will be made to post office boxes.
For each order placed on the Site, Antichi Sapori issues an invoice for the goods shipped, by sending it by e-mail or post to the order holder, pursuant to D.P.R.. 445/2000 and of the Legislative Decree. 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No changes in the invoice will be possible, after the issuance of the same.
Delivery costs are charged to the Customer and are clearly highlighted on the Site and in the order form.
All purchases will be delivered by express courier chosen by the customer during the purchase from those proposed by Antichi Sapori (right away, “Courier service”) from Monday to Friday, excluding holidays and national holidays. Antichi Sapori is not responsible for unforeseeable delays.
Antichi Sapori will send the Customer a confirmation e-mail once the Products have been shipped, in which the tracking number of the shipment will be specified, through which it will be possible to view, upon insertion on the Courier's website, the status of the shipment.
In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within a maximum period of 30 (thirty) days from the day following that on which the Customer sent the order to Antichi Sapori, unless Antichi Sapori communicates – within the same term, by e-mail – the inability to deliver the ordered goods as a result of unexpected unavailability, even temporary, of the Products. In case of such communication, Antichi Sapori will refund any sums already paid by the Customer for the payment of the supply. In the case of, against the communication of Antichi Sapori of a delay in the delivery date, the Customer wishes to cancel the Order, any amount already paid by the same will be reimbursed as soon as possible, and in any case not beyond 30 (thirty) days from the day following the day on which the Customer sent the order to Antichi Sapori .
For the delivery of the goods, the presence of the Customer or his representative at the address of the recipient indicated in the order is required. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the package is intact or not altered. Any damage to the package and / or the Products or the mismatch in the number of packages must be immediately notified by means of a written control reserve on the Courier's proof of delivery.. Once the Courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of the delivered package.

10. Right of withdrawal and RETURN

Pursuant to Legislative Decree. 06/09/05 N°206, the consumer customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within 14 days from delivery of the products. Although obvious, this right cannot be exercised in the event that the delivery has already taken place and for perishable food and / or household products..

To exercise this right, the customer must send a communication to the e-mail address commerciale@antichisaporisicilia.com indicating the product or products for which he intends to exercise the Right of Withdrawal, as long as it is intact.

Once the aforementioned withdrawal notice has been received, we will quickly communicate to the customer the instructions on how to return the goods.
The right of withdrawal is however subject to the following conditions:

The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
The right of withdrawal does not apply to goods made to measure or personalized and food or household use.
The purchased good must be intact.
According to law, the shipment of the products for their return, including related expenses, is the sole responsibility of the customer.
It is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
Upon arrival at the seller's warehouse, the product will be examined to assess any damage or tampering not caused by transport.
Without prejudice to any restoration costs for ascertained damage to the original packaging, the seller will refund the customer the full amount already paid, within 30 days from the return of the goods. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (Cod. ABI - CAB - Current Account of the invoice holder).

The right of withdrawal is totally lost, for lack of the essential condition of integrity of the asset (packaging and / or its contents), in cases where they are ascertained:

The lack of the external packaging and / or the original internal packaging;
The absence of integral elements of the product;
Damage to the product for reasons other than its transport.

11. Product Replacement
Antichi Sapori provides its Customers with the possibility of replacing the Products purchased through the Site.
To obtain the replacement of a Product it is necessary to follow the same procedure indicated above for the RETURN.
The Customer who is not fully satisfied must keep all the documentation relating to the delivery and the Product itself in its original packaging and immediately contact Antichi Sapori by e-mail at the following address: commerciale@antichisaporisicilia.com
The Product to be replaced must be received, in a normal state of conservation, to the following address: Ancient Flavors, Via Linnaeus, 42 Avola (SR) – ITALY. The fulfillment of the new order is subject to the availability of the requested Products.
The replacement Product will be sent to the Customer by courier without additional shipping costs.

12. Defects of conformity
In case of lack of conformity of Products sold by Antichi Sapori through antichisaporisicilia.com, the Customer must immediately contact our Customer Service at the e-mail address commerciale@antichisaporisicilia.com.
The legal guarantees provided for in the articles apply to the sale of the Products 129, 130 e 132 of the Consumer Code. The Customer has the right to have it restored, without fee, the conformity of the goods by repair or replacement or an adequate reduction in the price or termination of the contract. The Customer loses these rights, if he does not report the lack of conformity to Antichi Sapori within two months from the date on which he discovered the defect. The direct action to assert the defects not maliciously concealed by Antichi Sapori is prescribed, in any case, within twenty-six months from the delivery of the asset.

13. Sale of alcoholThe online seller declares to be aware of the criminal and / or administrative liability resulting from the sale of alcoholic substances to minors or resulting from other violations of certain age limits established by law. to verify, through a reliable procedure that includes a personal identity and age check, that the payer has reached the minimum age required.
14. Errors
The information relating to the Products provided on the Site is constantly updated. However, the complete absence of errors cannot be guaranteed.
Antichi Sapori reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also to change or update information at any time without prior notice.

15. Applicable law and competent court
These General Conditions are governed by Italian law and must be interpreted in accordance with Italian law.
For disputes arising from the interpretation, validity and / or execution, of these General Conditions the mandatory territorial jurisdiction will be that of the judge of the Court of Syracuse (SR).
